These are the Terms of Stanbic IBTC Mobile Banking APP, together with the terms and conditions that apply to any account or service you may access using this App (the Product Terms); and our Online Banking Terms and Conditions; and any other terms and conditions that we may advise you shall govern and regulate your use of this Mobile Banking APP. By downloading this App and enrolling for the Mobile Banking Services thereon (the Services), you are agreeing to be bound by all the terms and conditions contained herein. In the event of a conflict between the App Terms and the Product Terms or Online Banking Terms and Conditions, the App Terms will apply. The latest version of these Terms applies each time you use this App to access our Services Mobile Banking App Before you can use this App and our online services (including products), you must register with us, and we must accept your registration. We may accept or reject your registration at our sole discretion (in our own judgement) without giving reasons. Types of information on our App All information provided via this App is only intended to give you general information about us, our products, services and goals. You should not regard anything on our App and website as an offer, only as an invitation to do business with us. We provide all information "as is" and you may not rely on it or treat it as professional advice. You should always discuss any advice with a professional advisor before doing anything based on any information on this App. Changes to these Terms We may change these Terms from time to time. The latest version of these Terms apply whenever you use the App. A certificate (letter) signed by the administrator of this website is prima facie (initial) proof of the date and content of the latest and any previous version of these Terms. Information on our Mobile Banking App and Website We may use other organisations to provide information on this App and/or our website. We have no control over this information and do not warrant or guarantee that it is correct or suitable for anything. Any of this information is provided "as is" and we are not directly or indirectly responsible for any loss that may follow from you relying on it. Links to other websites The App may link to other websites with information or content from other parties. Although we try to only link to trustworthy parties or systems we are not responsible for any of this other information. If we provide a link to any other information, website, person or business, it does not mean that we have checked or approve of them. We do not give any warranty about any other website, software or hardware, including their security or performance. You waive (give up) any claim you may have against us for any loss or damage you may suffer because you connect to any other website. Non Permissible Activities You are not allowed to copy or reproduce all or any part of this App or alter, modify or adapt all or any part of the App. You shall not remove or tamper with any copyright notice contained within or attached to the App. You recognize that all ownership rights in the App is vested in and remains with us. The logos and trade marks on our App are our registered and unregistered trademarks or those of other parties. Nothing on our App and our website is a licence (permission) to use any trade mark for any other purpose without first getting written permission from us or any other party that has rights to the intellectual property Your Security Obligations You must take all reasonable precautions to keep safe and prevent fraudulent use of your mobile device and security information. These precautions include: never writing down or otherwise recording your security details in a way that can be understood by someone else; not choosing security details that may be easy to guess; taking care to ensure that no one hears or sees your security details when you use it; not disclosing your security details to anyone, including us; changing your security details immediately and telling us as soon as possible if you know, or even suspect, that someone else knows your security details; keeping your security details and mobile device safe; complying with all reasonable instructions we issue regarding keeping your security details safe; logging out of the Mobile Banking App once you have finished using the Mobile Banking App services and undertake reasonable and adequate safeguards to scan for computer viruses or other destructive properties. We will not be liable for any instruction given by you or anyone acting with your authority from the moment you log on to the Mobile Banking App until you log off the Mobile Banking App. You are responsible for making sure information shown or stored on mobile device is kept secure. You must advise us of any change to your mobile phone number without delay. Use of suitable Hardware and Software You must use and update hardware and software (phones, tablets, any electronic device or and programs) suitable for this App, our website and the online services. If you do not, the App may not work properly and this could increase your security risks. If we offer any software to you on or through our App and or website, the licence agreement is between you and the software licensor (owner). You indemnify us against any breach of a software licence. We do not expressly or implicitly warrant that any software is of good quality or suitable for its purpose. We also do not warrant that any file, download or application available on the communication system is safe to use on any phones, tablets. We cannot guarantee that it contains no software or data that can negatively affect an electronic device or computer system, such as viruses, trojans and other malicious software. Risks of sending information over the Internet. Information sent over the Internet, including email, can be intercepted, seen or changed. We take steps to limit these risks. Because we cannot stop all illegal activities, we are not responsible for any loss or damage you may suffer as a result. Closing, suspending or limiting the App and/or our website. We may change, suspend the use of this App and other online services temporarily or permanently without giving notice. We may also limit certain services, features or functions, and we may restrict access to all or parts of any service on the App. Disclaimer and limits of our responsibility Your use of this App is dependent on factors beyond our control, such as the network coverage or availability of your Internet Service Provider’s availability. We are not liable for any loss or damages you may suffer if a factor beyond our control arises, and you cannot access this App and our online services. You use this App and the online services entirely at your own risk. You are fully responsible for any loss or damage that may result from you using or not being able to use this App or any of its content, information or any online service. We (including our owners, agents, consultants, employees and any affiliated person) are not responsible for any loss or damages related to your use of this App and our online Services. This includes, without limitation, any direct, indirect, special, incidental, consequential or punitive damages in terms of any contract, tort (breach of a duty of care) or law, and even if we were expressly told that any loss or damage was possible. Legal Capacity You warrant to us that you are legally capable of agreeing to these Terms. If you are younger than 18, or if you are not sure if you can legally enter into agreements without your legal guardian agreeing to it with you, you must find out before you use the APP. Unauthorised transactions You will be responsible for all losses arising from unauthorised transactions on your account where you intentionally or negligently fail to use the Mobile Banking App in accordance with the Terms including but not limited to keeping your security details safe and secure, or you intentionally or negligently fail to notify us if you reasonably believe that someone else knows your security details or has used or tried to use your security details. We may deny you access to this App immediately in the following situations; If you fail to use the Mobile Banking App for 12 months or for such period as we may in our sole and absolute discretion determine; you will have to re-register in order to use the Mobile Banking App gain; or If you have consistently breached any of the Terms of this App or the Product Terms including where; you are, or we reasonably suspect you may be, using or obtaining, or allowing someone else to use an account or receive services or money illegally; or your account is, or we reasonably suspect your account is, being used for an illegal or fraudulent purpose; or we have reasonable grounds to suspect fraudulent use of your security details; or we have reasonable grounds for believing you have committed or are about to commit a crime in connection with your account; or you have not satisfied any anti-money laundering requirements or there has been or we suspect there has been fraud involving any of your accounts with us; or If there has been or we suspect there has been suspicious activity on your account; or If you stop holding any account, product or service in respect of which the Mobile Banking App may be used. General The headings in these Terms are only for information. Do not consider them when you interpret the Terms. Any favour we may allow you will not affect any of our rights against you, whether the favour is expressed (said) or implied (not said). We do not waive (give up) any of our rights. If any clause in these Terms is invalid or illegal or cannot be enforced, the remaining clauses will continue to be valid. The law that applies to these Terms The laws of Nigeria shall govern these Terms. The Terms of this App are in English language and any Communications we send to you will be in English. Except stated otherwise, all copyright in the screens, pages and any material included in the App is owned by or licensed to us or members of Stanbic IBTC Group. |
